How Chapter 13 Bankruptcy Works

By filing Chapter 13 bankruptcy, you enter into a payment plan with the court. You will generally be required to pay your secured debts in full, such as your home. However, the court will often approve a plan that requires you to only pay a small percentage of unsecured debts such as credit card bills and hospital bills. At the end of the payment period, your unsecured debts will be discharged.

The percentage of unsecured debts that you will be required to pay will depend on a number of factors, including how much income you have left over after paying your necessary monthly living expenses such as food, clothing, mortgage and car insurance.
